It is unlawful for any person to keep any livestock, including but not limited to cows, horses, goats, pigs, hogs, sheep, geese, ducks, and chickens, in the village except as provided for in this Section and subject to the restrictions of Title 17, Zoning.
A. Horses. Horses, including ponies, colts, mares, fillies, mules and asses, may only be kept in the zoning districts that allow equine stables (AG, E, SE, SR).
1. The minimum lot size to keep horses is two acres (87,120 sq ft).
2. One horse is permitted for each acre (43,560 sq ft) of lot area, rounding down to the lowest whole number.
B. Hens (female chickens). Hens may lawfully be kept in those districts (AG, E, SE, SR) that permit public or private equine stables. Hens may lawfully be kept on lots containing detached single-family dwellings in all other residential districts (R-1, R-2, R-3A, R-3B, R-3C, R-3D) and in the O-1 district subject to the following standards:
1. Lots with a minimum lot area of twenty thousand (20,000) square feet shall be allowed six (6) hens;
2. Lots with a minimum lot area of forty thousand (40,000) square feet shall be allowed ten (10) hens;
3. Care and housing of hens must comply with section 6.08.012 of this chapter; and
4. Hens must be licensed by the village of Beach Park per section 6.08.013 of this chapter, regardless of the zoning district or lot size.
5. The word “hen” shall only include the female of the species Gallus gallus domesticus.
C. Honeybees. Honeybees may lawfully be kept in those districts (AG, E, SE) that permit apiary uses. Honeybees may lawfully be kept on lots containing detached single-family dwellings in all other residential districts (SR, R-1, R-2, R-3A, R-3B, R-3C, R-3D) and in the O-1 district subject to the following standards:
1. Lots with a minimum lot area of twenty thousand (20,000) square feet shall be allowed one full hive and one nucleus hive;
2. Lots with a minimum lot area of forty thousand (40,000) square feet shall be allowed two (2) full hives and two (2) nucleus hives;
3. Care and housing of honeybees must comply with section 6.08.014 of this chapter; and
4. Honeybees must be licensed by the village of Beach Park per section 6.08.015 of this chapter.
5. The word “honeybee” shall only include the species Apis melifera.
D. Existing livestock. Goats, hens, and equines kept at a property prior to the effective date of this ordinance in a manner that is not in compliance with this ordinance may be maintained through the natural life of the individual animal(s) subject to the requirements of this section. Roosters must be relocated within one year of official notice by the Village.
1. There must be adequate documentation to demonstrate that the animal was lawfully kept at the property prior to the effective date of the ordinance.
2. Documentation of each animal (other than honeybees) must be provided to the Village. This document must include sufficient information (species, age, photographs) to identify each animal.
3. The property must be determined to be adequate for the proper keeping of the given animal(s). (Ord. 2015-O-6; amd. Ord. 2022-O-16)
