6.06.260: LIVESTOCK RUNNING AT LARGE:
   A.   Stray animals (livestock) may be impounded at a designated site willing to accept such animal(s). The impounding facility and its owner(s) shall not be held liable for any injury, but the property owner/owner of the animal will be held responsible for all fees related to the impoundment including the impoundment.
   B.   Notification of impoundment shall be given to the person or owner of livestock running at large, if known, and a maximum of twenty four (24) hours may be granted in which to make the necessary corrections, if the violation is an accidental occurrence and an investigation reveals no identifiable individual at fault. Any livestock allowed to run at large may be impounded (at the owner's expense) at a facility designated by the village of Beach Park or authorized agent or law enforcement agent or Lake County health department.
   C.   Any expense incurred in such impoundment shall become a lien on the livestock impounded and must be discharged before the livestock may be released to the owner, if impoundment costs are satisfied and the owner provides evidence that he is capable of restraining the livestock from running at large.
   D.   If the owner refuses or fails to provide such restraints, or the impounded animal(s) is not claimed and incurred costs not paid within the ten (10) day period of the impoundment, such animal(s) shall become the property of the designated stable in lieu of the impoundment, board and fee for service charges per the Lake County health department. In addition, all related fees associated with the impoundment of such animal(s) still remain the responsibility of the property owner/animal owner and these fees must be paid to the village of Beach Park in a specified amount of time as so stated in subsection 6.06.180D of this chapter. (Ord. 2007-O-84 § 2)
