11-4-2: STREETS:
   A.   Widths: Street right of way widths shall be as shown on the comprehensive plan and where not shown thereon, shall not be less than as follows:

In the sole discretion of the city, a reduction in right of way may be granted if the proposed development abuts existing development with less right of way or if it is a replat of a previously platted development.
   B.   Intersections: Insofar as practical, streets shall intersect at right angles. In no case shall the angle formed by the intersection of two (2) streets be less than sixty degrees (60°). Intersections having more than four (4) corners shall be prohibited, unless they all intersect into a roundabout. Adequate land for known future intersection and exchange construction needs shall be provided for.
   C.   Deflections: When connecting street lines deflect from each other at one point by more than ten degrees (10°), they shall be connected by a curve with a radius adequate to ensure a sight distance of not less than five hundred feet (500') for arterials, three hundred feet (300') for collectors, and one hundred feet (100') for all other streets. The council may allow greater or lesser sight distances at the recommendation of the city engineer.
   D.   Centerline Gradients: All centerline gradients shall be at least 0.5 percent and shall not exceed the following:
      1.   Arterial streets and collector streets: Four percent (4%).
      2.   All other streets: Six percent (6%).
   E.   Vertical Curves: Different connecting street gradients shall be connected with vertical curves. Minimum length in feet of these curves shall be thirty (30) times the algebraic difference in the percent of grade of the two (2) different slopes.
   F.   Street Jogs: Street jogs with centerline offsets of less than one hundred twenty five feet (125') shall be avoided.
   G.   Local Streets: Local streets shall be designed so that their use by through traffic will be discouraged.
   H.   Access To Arterials And Collectors: In the case where the proposed plat is adjacent to any limited or controlled access state or county roadways, there shall be no direct vehicular or pedestrian access from individual lots to such arterials without written approval of the road authority. As a general requirement, access to arterials shall be at intervals of not less than one- fourth (1/4) mile and via existing and established crossroads where possible. The city may require controlled access designation of various segments of city arterial and collector streets if alternative access exists and there are traffic safety concerns.
   I.   Temporary Entrance Permit: In the platting of small tracts of land fronting on limited or controlled access roadways in the city, where there is no convenient access to existing or planned entrances and where access from such plat would be closer than one-fourth (1/4) mile from an existing or planned access point, a temporary entrance permit may be granted by the city. Provision shall be made in such plats for the connection of roads to neighboring land. As the neighboring land is platted and developed, and access becomes possible at the preferred location (in the sole determination by the city council), such temporary entrance permits shall become null and void and reconstruction of the disturbed area shall be done to the satisfaction of the city public works director.
   J.   Half Streets: Half streets shall be prohibited except where it will be practical to require the dedication of the other half when the adjoining property is subdivided; in which case the dedication of a half street may be permitted. The probable length of time elapsing before dedication of the remainder of said street shall be considered in this decision. In this circumstance a "half street" shall require a minimum of forty feet (40') of right of way until the other half street is acquired. No building permits shall be issued for a building located on a lot fronting on a half street.
   K.   Hardship To Owners Of Adjacent Property: The street arrangements within such proposed plat shall not be such as to cause hardship to owners of adjoining property in platting their own land and providing convenient access to it.
   L.   Dedication And/Or Private Streets: All proposed public streets shown on the plat shall be dedicated to the public on the plat. If accepted by the city, private easements may be allowed in lieu of public streets. In these cases, however, the easements shall be depicted on the plat and a maintenance agreement binding all lots served by said easement shall be approved by the city and recorded with the plat.
   M.   Ditches: All streets without storm sewers shall have a minimum of two foot (2') ditches measured below the driving surface which shall not be filled at any time thereafter.
   N.   Storm Sewer: Streets in industrial, commercial and multi- family districts shall include storm sewers with standard curb and gutter design.
   O.   Private Drives: Any proposed subdivision that does not access the plat by a dedicated public right of way shall comply with the following provisions:
      1.   Any easement that provides access from the subdivision to a public right of way must be at least forty feet (40') in width and at least twenty six feet (26') of this right of way must be bituminous.
      2.   The applicant of the proposed subdivision must present a certificate of survey by a licensed surveyor depicting said easement.
      3.   Said easement must be of record.
      4.   If the easement crosses lands not owned by the applicant of the proposed subdivision, covenants or agreements of record must define the maintenance obligations of the easement area.
      5.   The public right of way that serves said easement must be within the city limits of Baxter.
      6.   The easement shall not have any turns or dead ends that prevent fire or other emergency vehicles from servicing all homeowners within the proposed subdivision.
      7.   These provisions apply to a lot split otherwise exempt from the subdivision's rules pursuant to section 11-2-1 of this title.
      8.   This section shall not apply to easements constructed prior to the passage date hereof as long as the easement roadway is bituminous. (Ord. 2014-02, 2-18-2014)
