662.07 APPEALS; SCOPE OF JUDICIAL REVIEW.
   (a)   An owner aggrieved by any final determination by the City Commission under this chapter may appeal the determination to the Calhoun County Circuit Court within fourteen days from the date of service by first class mail upon the owner, or by publication in a local newspaper of general circulation, whichever is later, of the City Commission's decision.
   (b)   The Circuit Court shall be limited in its review of the City Commission's decision to determine whether an error of law, fraud or abuse of discretion exists and whether the decision is supported by competent, substantial and material evidence on the record as a whole. The Circuit Court's review shall be made upon the record made before the City Commission. The burden of proof shall be on the appealing party.
