6-2-4: TRAFFIC ACCIDENTS:
   A.   Traffic Division To Investigate: It shall be the duty of the Traffic Division, assisted by other police officers of the Department, to investigate traffic accidents, to arrest and to assist in the prosecution of those persons charged with violations of law causing or contributing to such accidents. (1972 Code § 70.025)
   B.   Traffic Accident Studies: Whenever the accidents at any particular location become numerous, the Traffic Division shall conduct studies of such accidents and determine remedial measures. (1972 Code § 70.030)
   C.   Traffic Accident Reports: The Traffic Division shall maintain a suitable system of filing traffic accident reports. Accident reports or cards referring to them shall be filed alphabetically by location. Such reports shall be available for the use and information of the Police Department, the Chief of Police, and such other persons as may be legally entitled to such information. (1972 Code § 70.035)
   D.   Immediate Notice Of Accident: The driver of a vehicle involved in an accident shall immediately by the quickest means of communication, give notice of such accident to the Police Department, if such accident occurs within the City. (1972 Code § 71.045)
   E.   When Driver Unable To Report:
      1.   Whenever the driver of a vehicle is physically incapable of giving an immediate notice of an accident as required in subsection D and there was another occupant in the vehicle at the time of the accident, capable of doing so, such occupant shall make or cause to be given the notice not given by the driver.
      2.   Whenever the driver fails, for any reason, to make a written report of an accident, and such driver is not the owner of the vehicle, then the owner of the vehicle involved in such accident shall, within five (5) days after the accident, make such report not made by the driver. (1972 Code § 71.055)
   F.   Public Inspection Of Reports Relating To Accidents:
      1.   All written reports made by persons involved in accidents or by garages shall be without prejudice to the individual so reporting and shall be for the confidential use of the Police Department or other governmental agencies having use for the records for accident-prevention purposes, except that the Police Department or other governmental agency may disclose the identity of a person involved in an accident when such identity is not otherwise known or when such person denies his presence at such accident.
      2.   No written reports forwarded under the provisions of this subsection shall be used as evidence in any trial, civil or criminal, arising out of an accident except that the Police Department shall furnish, upon demand of any party to such trial, or upon demand of any court, a certificate showing that a specified accident report has not been made to the Department in compliance with law, and if such report has been made, the date, time and vehicles involved, and the investigating officers.
