5-2-5-3: GAMBLING DEVICES:
   A.   Gambling Devices And Sweepstakes Machines Prohibited: It shall be unlawful for any person to lease, own, keep or possess any gambling device, gambling paraphernalia or sweepstakes machine with the intent to use the same for an unlawful purpose in any premises open to the public within the City. Any owner, tenant, manager or person having supervisory authority of any premises open to the public at which a gambling device or sweepstakes machine is owned, leased, operated or placed into operation or allowed to be used or operated shall be considered guilty of violating this section.
   B.   Seizure Of Gambling Devices: City law enforcement officers may seize any device kept or used in violation of this section and, upon conviction of the keeper thereof, such device so seized shall be destroyed. It is a violation of this section for any person to obstruct or resist a police officer in the performance or exercise of the authority given in this section.
   C.   Penalty: Any person violating any of the provisions of this section shall be fined not more than seven hundred fifty dollars ($750.00) for each offense. Each machine or device found to be in violation, and each day such violation occurs or continues, shall constitute a separate and distinct offense. A separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.
   D.   Video Gaming Terminals - Not Prohibited: Nothing contained in this section shall be construed as prohibiting duly licensed video gaming terminals as authorized by title 3, chapter 26 of this Code. (Ord. 19-44, 6-3-2019)
