5-2-4-2: BLASTING OF EXPLOSIVES:
   A.   Conditions Under Which Blasting Permitted: It shall be unlawful to use, set off or detonate any explosive compound, such as dynamite, nitroglycerine, or any other explosive, blasting powder or compound, for the use or purpose of aiding in or making any excavation or ditch, or for any other purpose, in any portion of the City zoned for residential or business purposes, and where any structures, houses or buildings are located closer than five hundred feet (500') to the point where such blasting, excavation or other use of explosives would occur, except in compliance with all of the following conditions:
      1.   A surety bond in the sum of twenty thousand dollars ($20,000.00) shall be filed with the City Clerk, conditioned upon the indemnification of any and all damage to buildings, structures and appurtenances thereto that may be caused by, or result from, the use of such explosive charge or charges.
      2.   The written consent of all owners of property, on which any building, house or structure, located within five hundred feet (500') of the site where the proposed blasting is to be done, shall be obtained.
      3.   The issuance by the City Council of a permit for such work must be obtained. Such permit may be issued on application of the property owner, which application shall state:
         a.   That the surety bond required has been filed, and the written consent of the adjoining property owners has been obtained.
         b.   The location of the premises involved, and the date and hour when such blasting is to be done, as well as the size and type of charge or explosive to be used. (1972 Code § 135.050)
   B.   Permit Required: In addition to the requirements of subsection A, no excavation for a ditch or other connection to a City water or sewer main shall be made which shall involve the use or detonation of any explosive material except on application to the City Council for a permit therefor, and the issuance by the City Council of such a permit. Such application shall be accompanied by a surety bond in the amount of twenty thousand dollars ($20,000.00), conditioned upon indemnification of the City for any breakage or damage to the sewer or water mains, or both, as a result of such explosion or detonation.    C.   Penalty: Any person violating the provisions of this Section shall be fined not more than five hundred dollars ($500.00) for each offense. (1972 Code § 135.060; amd. 1986 Code)
