3-27-7: ENFORCEMENT; FINES; SUSPENSION AND REVOCATION:
   A.   Any person who violates any provision in this chapter may be fined for each violation in the amount of one hundred dollars ($100.00). Each day that a violation continues after notice shall be considered a separate violation.
   B.   Any owner of rental property who fails to file an application for a rental license or owner or property manager who fails to complete the conditions for issuance of a rental license as required in this chapter shall be fined one hundred dollars ($100.00) and may be fined one hundred dollars ($100.00) for each day that an application for rental license is not filed or the conditions are not satisfied as required without good cause shown.
   C.   The Community Development Director may suspend and/or recommend revocation of any rental license issued hereunder if it appears to his satisfaction from the report of any City officer or City employee or any other available information, that the holder of a rental license or any other owner, after notice and sufficient opportunity to respond appropriately, has:
      1.   Violated any law or ordinance and continues to violate such law or ordinance in spite of notice and a reasonable opportunity to come into compliance with the law or ordinance;
      2.   Failed to apply for or satisfy the conditions for a rental license in spite of notice of non-compliance and reasonable opportunity to apply or satisfy the conditions for a rental license;
      3.   Violated the provisions in section 3-27-6 of this chapter regarding nuisance and has failed to take action reasonably calculated to prevent or stop nuisance activity or to prevent the same or similar activity from happening again in spite of notice of non-compliance and reasonable opportunity to comply with the requirements of section 3-27-6 of this chapter;
      4.   Been operating in a manner not conducive to the public health, morals or safety of the City and continues to operate in such manner in spite of notice and a reasonable opportunity to refrain from so operating; or
      5.   Failed any code inspection and has not corrected the noted deficiencies or is not pursuing compliance within the time frames set by the Community Development Department.
Suspension may be for up to thirty (30) days. Any owner of rental property for which a rental license has been suspended or revoked is prohibited from entering into any new leases during the period of suspension or revocation.
   D.   In addition to fines, suspension and revocation, the City may seek such other injunctive or additional relief as is available in the law to enforce the provisions of this chapter, to abate nuisances and to protect the health, safety and welfare of the public.
