3-26-2: LICENSE REQUIRED; LIMITATIONS:
   A.   No video gaming terminal operator may place a video gaming terminal for operation in the City unless the video gaming terminal is placed at a licensed video gaming location and the video gaming operator has paid an annual location permit fee of one thousand five hundred dollars ($1,500.00) for the licensed video gaming location, which location license shall be renewed on or before January 1 of each year.
   B.   No property owner or person in possession of property in the City shall allow a video gaming terminal to be placed or maintained on the premises unless the premises qualifies as a licensed video gaming location as defined in section 25 of the Video Gaming Act, including liquor establishments having a Class A, D, or E-3 license for consumption on the premises, licensed veterans establishments, licensed truck stop establishments, or licensed fraternal establishments and:
      1.   The licensee has entered into a written use agreement with a State-licensed gaming terminal operator for placement of the terminals and has the written use agreement(s) on file as required by section 25(e) of the Video Gaming Act.
      2.   The licensee has obtained both a State and a City license for the establishment and for each video gaming terminal.
      3.   If the licensee qualifies on the basis of being a liquor establishment as defined in the Video Gaming Act and this chapter, the licensee must have liquor license or be the purchaser of a business that had a liquor license at the time of the sale for at least one (1) year immediately prior to applying for a video gaming license. The mere fact that a person is purchasing a business that has a video gaming license does not guarantee the purchaser that a video gaming license will be granted to the purchaser.
      4.   The gaming terminal operator has paid the annual location permit fee of one thousand five hundred dollars ($1,500.00) for the licensed video gaming location.
      5.   The licensee has paid a fee of twenty five dollars ($25.00) for each video gaming terminal on the premises, which fee shall be paid for renewal on or before January 1 of each year. (Ord. 17-11, 2-6-2017; amd. Ord. 17-39, 6-5-2017; Ord. 19-77, 12-2-2019)
