A. License Required: No person shall operate or maintain a go-kart amusement facility or similar facility within the city which is open to the public, without first having obtained a license therefor as herein provided. Applications for such licenses shall be made in writing to the city clerk and shall state thereon the intended location of such place of amusement or recreation.
B. License Fee: The annual license fee for any such license shall be twenty five dollars ($25.00) and such fee shall be entitled to be prorated only on a semiannual basis.
C. Racing Of Go-Karts:
1. Racing of go-karts shall be permitted as an activity at a go-kart amusement facility so long as such racing does not utilize go-kart vehicles designed and constructed exclusively for racing, and further that the vehicles utilized in such racing shall not be designed or constructed to allow speeds in excess of twenty eight (28) miles per hour.
2. The operator of the go-kart amusement facility shall submit the facility to such safety inspections (at least annually) as required by the Illinois department of labor and obtain all necessary approvals and certifications in connection therewith. Proof of obtaining such approvals and certification shall be submitted to the city of Batavia at the time of the application or renewal of the license required herein.
D. Hours Of Operation: No such amusement shall be open to the public later than twelve o'clock (12:00) midnight and earlier than nine o'clock (9:00) A.M. of any morning. (Ord. 04-54, 11-15-2004)
