3-4-9: MOTION PICTURE THEATERS:
   A.   License Required: It shall be unlawful to give, present or conduct any motion picture or theatrical for admittance to which a fee is charged, excepting performances given solely for the benefit of and under the supervision and auspices of a religious, educational or charitable organization, without first having secured a license therefor as is herein provided. (1972 Code § 115.250)
   B.   Applications For License: Applications for such licenses shall be made in conformance with the general provisions relating to such applications 1 , and shall give in addition to the other information required the place of the intended performance and the seating capacity thereof. (1972 Code § 115.255)
   C.   License Fee: Any person securing an annual license for motion pictures, or theatricals naming a specific place or building in which the performances are to be presented may present therein any number of performances, including theatricals, during the year for which the license was secured without having to pay any additional fee. (1972 Code §§ 115.260, 115.265)
      1.   The annual license fee for such license shall be two hundred fifty dollars ($250.00).
      2.   For motion pictures or theatricals to be presented in premises not covered by such an annual license the fee to be paid shall be ten dollars ($10.00) per day. (1972 Code §§ 115.260, 115.265; amd. 1986 Code)
   D.   Crowding; Order: It shall be unlawful to permit any person, excepting ushers or other theater employees, to remain standing in a hall or room in which a motion picture or theatrical is presented during the time of such performance; and it shall be unlawful to admit to any such hall more persons than can be accommodated by the seating arrangements for the premises. (1972 Code § 115.275)
   E.   Building And Premises:
      1.   It shall be unlawful to use any scenery in any theater other than noninflammable scenery or such as shall have been rendered noninflammable by application of fire preventive coatings. (1972 Code § 112.280)
      2.   Building Requirements: It shall be unlawful to present any public motion picture or theatrical in any building or structure which does not contain the number of exits required for buildings or places intended for motion picture performances by the ordinances of this Municipality 2 or by statute; or in premises in which the electrical wiring does not fully comply with the ordinances. All places used for the exhibition of motion pictures or theatricals must be kept adequately ventilated during the performance and for so long a time as the audience may remain therein. (1972 Code § 115.285)
      3.   Exits: It shall be unlawful to obstruct or permit the obstruction of any aisles, corridors or exits leading from any room or enclosure in which a motion picture or theatrical performance is being given or in which an audience for such a performance is gathered. (1972 Code § 115.290)
