(A) Platting. Any property which is to be subdivided shall first be determined by the Environmental Health Division to be suitable for an on-site wastewater treatment system. Providing suitability, a certificate of approval shall be issued to the property owner for submittal of his or her plat to the Plan Commission.
(B) Construction permits. Before commencement of construction of any building where a private on-site wastewater treatment system or privy is to be installed or where any alteration, repair or addition of an existing private on-site wastewater treatment system is planned, the owner or agent of the owner shall first obtain a written permit signed by the Health Officer. The application for the permit shall be made on a form approved by the State Department of Health, which application shall be supplemented by a copy of the plat map, maintained in the Office of the County Auditor, showing location of property and any plans, specifications and other information as deemed necessary by the Health Officer. The Health Officer may require that plans and specifications for private on-site wastewater treatment systems be submitted to the State Department of Health for approval.
(1) Before issuance of a building permit for construction which may increase the wastewater load or impede or obstruct the on-site wastewater system, approval must be obtained from the Health Officer.
(2) If the on-site wastewater treatment system has not been constructed within two years from the date of issuance for a new installation or within six months from date of issuance for a repair, the permit shall automatically be terminated unless an extension is warranted by the Health Officer.
(C) Distribution of fees. All fees collected under the terms of this chapter shall be receipted monthly into the County Health Fund for services rendered in enforcing this chapter. Fees shall be collected as provided for by County Ord. 1992-07, (two copies of which are on file in the Auditor's Office).
(D) Registration.
(1) No person shall install an on-site wastewater treatment system for hire who is not registered in the county. A person shall become registered by demonstrating competence in knowledge of county and state on-site wastewater treatment system codes through a test administrated by the County Environmental Health Division. Once registered, the person shall be given a registration card and put on a list that is available to the public. Annual renewal will be required.
(2) Failure to uphold the on-site wastewater treatment system codes by violating a permit, not obtaining a permit, or otherwise falsifying an installation shall result in losing registration for the first offense of not more than 30 days; for the second offense of not more than 180 days and for the third and each subsequent offense of not more than one year. In addition, any person who shall violate any provision of this section shall be subject to the penalties provided in § 51.999.
(E) Inspections.
(1) A pre-construction review with the on-site wastewater system installer may be required for all installations.
(2) The provisions of the permit for the construction, installation, alteration or repair of a private on-site wastewater treatment system or privy shall not be considered to be fulfilled until the work is completed and has been inspected and approved by the Health Officer.
(3) The Health Officer, having proper credentials and identification, shall be permitted to enter upon all properties at the proper time, after giving due notice for purpose of inspection, measurement, observation, sampling and testing necessary to carry out the provisions of this chapter.
