(A) Any person who violates any provision of this chapter shall for a first offense be fined not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00), and for a second or subsequent offense shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00). Each day on or during which any person violates any of the provisions of this chapter shall constitute a separate offense.
(B) Any person who violates any provision of this chapter may avoid prosecution for said violation by returning the issued citation or other notice of violation and paying the village treasurer within ten (10) days from the date appearing on said notice of violation, the sum of fifty dollars ($50.00) in cash or by certified check. Any person making such payment shall receive a receipt from the village treasurer. If payment is not made within ten (10) days, legal action may be instituted against the violator.
