(A) Any person, firm or corporation convicted of any violation of sections 9-2-6-2, "Axle Loads And Maximum Weights", and 9-2-6-3, "Temporary Prohibition Of Certain Classes Of Vehicles", of this title, including, but not limited to, a maximum axle or gross limit specified on a regulatory sign posted in accordance with section 9-2-6-3 of this title, shall be fined according to the following schedule:

5,001 or more | The fine shall be computed at the rate of $75.00 for each increment of 500 pounds overweight or fraction thereof |
In addition any person, firm or corporation convicted of four (4) or more violations of section 9-2-6-2 or 9-2-6-3 of this title within any twelve (12) month period shall be fined an additional amount of two thousand five hundred dollars ($2,500.00) for the fourth and each subsequent conviction within the twelve (12) month period. Provided, however, that with regard to a firm or corporation, a fourth or subsequent conviction shall mean a fourth or subsequent conviction attributable to any one employee-driver.
