8-4-1: DEFINITIONS:
For the purpose of this Chapter, the following definitions shall apply:
ANIMAL: Any living vertebrate, except a human being.
BITE: A seizure of a person with the jaws or teeth of any animal capable of transmitting rabies so that the person so seized has been wounded or pierced and further includes contact of the saliva of such animal with any break or abrasion of the skin.
CONFINED: The restriction of the animal at all times by the owner in a manner that will isolate the animal from the public or other animals.
CONTROL: The securing of any animal by a leash, lead, electrical/mechanical device or voice control, or within or about the premises of its owner or the premises owned by another person with the consent of that person, or confined with any crate or cage or confined within a vehicle.
OWNER: Any person having the right of property of an animal, who keeps or harbors an animal, who has an animal in his care, acts as its custodian or who knowingly permits an animal on or about any premises occupied by him.
STRAY ANIMAL: Any animal that is not under control, is molesting persons by chasing, menacing or biting, is chasing vehicles, is attacking another animal or is damaging property other than the property of the owner of the animal.
VOICE CONTROL: The immediate recall of an animal at the sound of the voice of the owner. (Ord. 93-8, 7-26-93)
