(D) Fishing, Consent Required: It shall be unlawful to take fish by means of any device within the waters flowing or standing on the land of another without first having obtained permission in writing from the owner or occupant of the premises where such fishing is done. Any written consent shall be dated and specify with particularity the date or dates for which such permission is given, and provided further, that such fishing shall not be carried on so as to cause wanton or careless injury to or destruction of any real or personal property on such premises.
