§ 35.01 LICENSE FEES.
   (A)   License fees. The following license fees on occupations, activities, and businesses within the county are hereby imposed pursuant to the laws of the Fiscal Court, and the same shall be effective, beginning July 1, 1994, for the fiscal year and until the same is modified or rescinded.
      (1)   A license fee of $10 per annum is imposed on each restaurant serving meals.
      (2)   A license fee of $10 per annum is imposed on each retail outlet of soft drinks and/or ice cream, and soft drinks are sold by the same retail outlet then on license of $5 per annum is hereby imposed.
      (3)   A license fee of $30 per annum of the first table or alley and $5 per annum for each additional table or alley is imposed on each billiard or pool hall or bowling alley irrespective or size, where a fee is charged and collected, directly or indirectly.
      (4)   A license fee of $10 per annum is imposed on each place where tobacco products are sold at retail.
      (5)   All license fees shall be payable to the County Clerk and be credited to the General Fund of the county to be used for county purposes only, pursuant to KRS 137.115(2). The County Clerk is hereby allowed a commission of 5% of the license fee, collected and accounted for by him or her and a $1.50 fee for license issuance as the Clerk’s sole compensation for issuance of said licenses and keeping the records thereof.
   (B)   Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
      RESTAURANT. Any business establishment serving food heated on the premises.
