2-2-9: CONDITIONS OF LICENSE:
Except as provided in this Section, no license shall be transferred or sold, nor shall it be used for any place not described in the license at the time of issuance, nor shall it be subject to attachment, garnishment or execution.
   A.   License A Personal Privilege: A license issued under this Chapter shall be personal privilege, good for one year unless sooner revoked. (Ord. 82-04, 5-18-1982)
   B.   License Term: Effective hereafter, the annual date for consideration by the governing body of license and permit issuance, renewals and transfers, shall be the second regular governing body meeting in March. (The license date is April 1. Publications in the newspaper and the hearing shall be prior to April 1.) Accordingly, the term of any licenses or permits issued prior to that time shall be less than one year to coincide with the annual date, and the annual fee shall be prorated accordingly. Any licensee not attempting to renew a newly issued pro-rated license or permit shall not be eligible for any license or permit authorized under this Chapter for a period of two (2) years after the expiration date of the prorated license or permit. The executor or administrator of the estate of any deceased licensee, when such estate consists in whole or in part of the business of selling alcoholic or malt beverages under a license, may exercise the privilege of the deceased licensee under such license until the expiration of the same.    C.   Transfer Of License: After public hearing and with the approval of the governing body, a license or permit may be transferred to or renewed on different premises on the same basis as the original application, except that no additional license fee is required during the term of the license or permit. A transferred license or permit shall expire on the same date as the original license or permit. The owner of a license or the executor or administrator of the estate of any deceased licensee, by an actual bona fide sale made in good faith, may, if proceedings are not pending to suspend, revoke or otherwise penalize under this chapter the license holder, assign and transfer such license. The assignee or transferee thereof, subject to the condition and approval stated in this section, may exercise the privilege of continuing the business authorized by such license without the payment of any additional license fee until the expiration of the same; provided, that such assignee or transferee shall first make and file a sworn application showing the qualifications of such person or assignee or transferee to take and hold a retail liquor license as required by section 2-2-3 of this chapter, and subject to the approval of the governing body first had and obtained; provided, that the governing body shall notify in writing the state liquor commission at least ten (10) days prior to the approval of such transfer or sale.    D.   Licensee, Employee, Or Licensed Operator To Be On Premises At All Times: There shall be upon liquor license premises, at all times, the licensee, the agent named in the license if the licensee is a corporation or limited liability company, or some person who shall have an operator's license and who shall be responsible for the acts of all persons serving, as waiters or in any other manner, any alcoholic beverages to customers. No person other than the licensee, or the agent named in the license if the licensee is a corporation or limited liability company, shall serve alcoholic beverages in any place operated under a liquor license unless he/she shall possess such operator's license, or unless he/she shall be under the immediate supervision of the licensee or a person holding an operator's license who shall be at the time of such service upon said premises. No person may manage premises operating under a liquor license or permit, unless the person is the licensee or permittee, an agent of the corporation or limited liability company or the holder of an operator's license.
   E.   Failure To Display Signage Referencing Open Container Law: All licensees are required to post signage on all public access exit doors stating, "No Drinks Beyond This Point Per Wyoming State Statutes 12-4-410 And 31-5-235". This signage is an effort to reduce open containers outside of the licensed premises. Licensees who fail to post signage on any public exit will be assessed the assigned demerit point value.
