1-10-9: METHODS OF SEPARATION:
   A.   Resignation: Employees who wish to voluntarily resign from their position with the town are expected to provide a written resignation to their supervisor two (2) weeks (10 working days) in advance of the anticipated resignation date. The letter of resignation shall remain a part of the employee's permanent personnel file. Failure by an employee to provide sufficient notice may result in his not being eligible for reinstatement privileges.
   B.   Retirement: There is no mandatory retirement age, although the normal retirement age is seventy (70), and continuation beyond that time is subject to meeting usual performance standards.
   C.   Layoff: If it shall become necessary to lay off town employees due to lack of funds, lack of work or reorganization, the mayor and the town council shall render the final decision as to the layoff. In administering layoff actions, the total length of service with the town and the performance of the employee shall be taken into consideration.
      1.   In conducting the layoff, however, the following concerns should be taken into account by the administering authority:
         a.   The needs of the town;
         b.   Performance of the employee;
         c.   Special abilities the employee may possess;
         d.   Total seniority time of affected employee.
An employee who is to be laid off shall receive written notice at least ten (10) working days prior to the effective layoff date. A layoff is not considered to be a termination and, therefore, is not subject to appeal under the town's appeal procedure.
      2.   Former employees of the town may be eligible for reinstatement within five (5) years of the initial date of separation, if the employee was laid off from service in good standing. Such employee shall be eligible for any position vacancy in a class equivalent to the class which the individual formerly occupied. In all cases, former employees must meet the minimum qualifications of any position to which they are to be reinstated. Reinstatement may be made without regard to the standard competitive selection process established and required in filling job vacancies; but, in all cases, the decision to reinstate a former employee shall be at the prerogative of the Mayor and Town Council.
