1-9-1: FIRE CHIEF:
   A.   Appointment, Term Of Office: The fire chief shall be appointed and may be removed by the mayor with the approval of the governing body. He shall hold office for the duration of his appointment as set forth in subsection 1-6-7A of this title, unless sooner removed by the mayor with the concurrence of the governing body.
   B.   Head Of Department: The fire chief shall be the head of the department and shall be directly responsible to the mayor.
   C.   Appoint Other Officers: The fire chief may appoint such other fire department officers as may be deemed necessary, including, but not limited to, a first assistance chief, a second assistance chief, a rescue squad captain, a secretary and a treasurer, subject to the approval of the governing body.
   D.   General Duties: The fire chief shall:
      1.   Be responsible for the discipline, good order and proper conduct of the entire department, and for the enforcement of all ordinances and regulations pertaining to it.
      2.   Be responsible for the proper care of the houses, fire apparatus and all other property of the department or in its charge.
      3.   Have command and control over all officers and members of the department and all houses, fire apparatus and other property of the department or in its charge, and he likewise shall have control of all persons present at fires and shall have power, if need be, to summon any and all able bodied persons to aid in extinguishment of any fires, in removing property from burning or exposed or endangered building and in guarding such property, and any able bodied person refusing to obey such summons shall be liable to penalty as provided in this code 1 .
      4.   Execute, or cause to be executed, all process or orders issued to him by the municipal judge.
      5.   Devote his time and energy to the affairs of the town and the state.
      6.   Investigate, or cause to be investigated, any and all fires, or reports of fire hazards, to protect the health, safety and welfare of the town.
      7.   Take an active part in the mutual aid program to assist other agencies in firefighting, fire prevention and in any other programs which will benefit any resident of the state, as is authorized by the mayor and governing body.
   E.   Records And Reports:
      1.   Immediately after assuming office and annually thereafter, the fire chief shall make an inventory of all property owned by the department or in its charge, noting the condition of each article. The inventory shall be submitted to the mayor and town council at the regular meeting of the town council last occurring before the meeting in which the town council annually considers and enacts the appropriation of funds to defray expenses of the Town for the fiscal year. The Chief shall accompany the inventory of equipment with a list of his recommendations for the purchase of additional equipment, and repairs to existing equipment that he may deem necessary, and any other recommendations he may desire to submit affecting the Fire Department.
      2.   The Chief shall inspect or cause to be inspected by members of the Department, at least twice annually, and more often if necessary, all fire hydrants and shall list those needing attention in his next succeeding report to the Town Council.
      3.   The Chief shall maintain, in the office of the Town Clerk, an accurate list of the members of the Department, and shall promptly report any additions to or withdrawals from the membership. Accidents involving members of the Fire Department in the performance of their duties shall be immediately reported by the Chief to the Mayor and Town Council.
      4.   The Chief of the Fire Department shall keep or cause to be kept a complete record of the activities of the Fire Department and shall make a thorough investigation of each fire and report monthly to the Mayor and Town Council giving in detail the following information in regard to each, if available: cause, location, time, owner, tenant, occupancy, type of building, insurance carried, insurance paid, building loss, contents loss, how extinguished, apparatus used, firefighters present, adequacy of water supply and pressure, and any other information of value in a report, or desired by any Councilmember (Ord. 83-08, 9-6-1983)
