A. Definitions:
PARK(ED): The standing of a vehicle, whether occupied or not, upon a street. Park(ed) does not include stopping temporarily for the purpose of, and while actually engaged in, receiving or discharging passengers, or loading or unloading merchandise, or in obedience to traffic regulations, signs or signals, or any involuntary stopping of the vehicle by reason of causes beyond the control of the operator.
SNOW EVENT: Any accumulation of snowfall that requires designated snow routes to be plowed by the town of Bar Nunn.
B. Snow Routes Designated: Designated snow routes October 1 through March 31 shall be:
1. Both sides of the street, Sunset Boulevard from Salt Creek Highway to the west end of the street.
2. Both sides of the street, Tipton Street beginning at the Rimrock intersection, then east across Antelope Drive and Bel Vista Drive.
3. Both sides of the street, Siebke Drive from Mustang Trail to the Bar Nunn School Parking Lot.
4. Both sides of the street, Mustang Trail in its entirety.
5. Both sides of the street, McMurry Boulevard from Salt Creek Highway to the dead end portion west of Antelope Drive.
6. Both sides of the street, Nez Perce Trail north from McMurry Boulevard through the dead end portion north of Zuni Trail.
7. Both sides of the street, Tonkawa Trail north from McMurry Boulevard through the intersection with Zuni Trail.
8. Both sides of the street, all dead end street portions of Mandan, Absaroka, Omaha, Sioux, Lakota, Inca, Kalina and Zuni Trails.
9. Both sides of the street, Antelope Drive from McMurry Boulevard to the dead end north of Zuni Trail.
10. East side of the west side of the street, Antelope Drive from Salt Creek Highway to McMurry Boulevard.
C. Prohibition: If a snow event occurs during the months of October 1 of any year through March 31 of the next succeeding year, no person shall park any vehicle on a designated snow route street, or part thereof.
D. Penalties And Enforcement:
1. Any violation of this section shall constitute a misdemeanor.
2. Any violation of this section that continues for a period of twenty four (24) hours or more shall constitute a new and separate distinct violation.
3. A duly appointed law enforcement officer authorized to act on behalf of the town may:
a. Issue a ticket to the owner of any vehicle that is parked in violation of this section; and/or
b. Have the offending vehicle towed, impounded, and stored if said vehicle:
(1) In the officer's discretion, creates a hazard or hinders the removal of snow; and/or
(2) Has not been removed from the snow route within twenty four (24) hours after the issuance of the ticket.
4. Any vehicle towed, impounded, and/or stored pursuant to this section may be released upon the payment of the costs and fees associated with the towing, impounding, and/or storage of the vehicle to the company or individual who has been engaged to impound and/or store the vehicle.
5. Any damage occurring to any vehicle as the result of the towing, impounding, and storage of the vehicle conducted pursuant to the terms of this section shall be the sole and separate responsibility or obligation of the titled owner or person in charge or having possession of the vehicle. The town shall bear no responsibility or obligation for any such damage.
6. Any damage occurring to a vehicle located within a designated snow route street, or part thereof, as the result of the towing, impounding, and storage of the vehicle, or as a result of the plowing and removal of snow from designated snow route streets, or parts thereof, by town employees and/or agents, shall be the sole and separate responsibility or obligation of the title owner or person in charge or having possession of the vehicle.
