3-1-5: CONTAINER REQUIREMENTS:
   A.   Residential: All residences located in any area in which collection is by the Town or approved contractors shall have sufficient container capacity to accommodate their normal volume of solid waste between collections. The type, size and number of containers, as prescribed by the Town, shall be as follows:
      1.   All garbage and refuse shall be placed in metal or plastic containers designed for the receipt of such materials and be covered in such a manner that the contents are not susceptible to blowing, animal scavenging or fly breeding.
      2.   No container, other than those supplied by the Town or its approved contractors, shall be over fifty five (55) gallons in capacity.
      3.   Containers, except for fifty five (55) gallon drums, shall be tapered to facilitate emptying.
      4.   The gross weight of the container and contents shall not exceed seventy five (75) pounds, except where mechanical lift devices are utilized.
   B.   Commercial: All establishments and institutions located in any area in which collection is by the Town or approved contractors shall have sufficient container capacity to accommodate their normal volume of solid waste between collections. The type, size and number of containers, as prescribed by the Town, shall be as follows:
      1.   All garbage and refuse shall be placed in metal or plastic containers designed for the receipt of such materials and be covered in such a manner that the contents are not susceptible to blowing, animal scavenging or fly breeding.
      2.   No container, other than those utilizing mechanical lifting devices, shall be over fifty five (55) gallons in capacity.
      3.   Containers, smaller than fifty five (55) gallon drums, shall be tapered to facilitate emptying.
      4.   Hospital, medical and drug refuse shall be completely secure from foraging or scavenging.
      5.   The gross weight of the container and contents shall not exceed seventy five (75) pounds, except where mechanical lift devices are utilized.
      6.   Commercial containers, other than barrels, must meet the following ANSI requirements: containers must be able to withstand one hundred ninety one (191) pounds vehicle pull from the leading edge of the empty containers and be able to withstand seventy (70) pounds horizontal pull from the top leading edge.
      7.   Containers shall have safety markings color coded to met OSHA requirements and be worded as follows: "Notice - Containers must be placed on a flat, level surface." This must be conspicuously located on each of the two (2) narrow sides of the refuse bin. "Caution - Do not play on or around." This shall be placed on three (3) sides of the refuse bin, the front door or slant side and the two (2) narrow sides.
   C.   Planning Commission Approval: Before the building permits shall be issued for construction of commercial buildings and multiple dwelling units, plans for the adequacy, location and accessibility of solid waste containerization and storage facilities must be approved by the Zoning and Planning.
   D.   Certificate Of Occupancy: No certificate of occupancy shall be issued for such premises until the solid waste containerization and storage facilities plan has been completed. (Ord. 98-05, 8-4-1998)
