3-1-4: PRIVATE CONTRACTS FOR SERVICE:
   A.   Private Entities To Provide Service: The Town shall provide its garbage and refuse collection through private entities. On an annual basis, the Town Council shall negotiate and enter into such contracts as are necessary to acquire the services of private entities to perform garbage and refuse collection.
   B.   Rules And Regulations: From time to time, the Town shall adopt reasonable rules and regulations not inconsistent with this Chapter nor Federal and State rules and regulations, to govern the operations of their private garbage and refuse collectors.
   C.   Rates Established: The fees to be charged for collection activities shall be established by the Town. Billing for the services shall be submitted to the residents through the Town Clerk. In the event that any bill shall not be paid when due and becomes past due in excess of thirty (30) days, the Town shall notify the private contract collector of such delinquency. Upon such notification, the private collector will remove the collection containers from the nonpaying residents and will refuse to collect any garbage or refuse until such time as the bill is paid in full to the Town Clerk.
   D.   Payment Of Fees: The fees to be charged for the collection and removal of garbage and refuse shall be established from time to time by resolution of the governing body premised upon the contract negotiated with the private contractor. (Ord. 98-05, 8-4-1998)
