909.02 FAILURE TO CONSTRUCT.
   (a)   When requested by Council, the Village Administrator shall notify any property owner to construct or repair the sidewalk along the street and immediately in front of his property, in accordance with the specifications on file in the office of the Village Administrator. If such sidewalks are not constructed within fifteen days or repaired within five days after receipt of such notice by the property owner or completion of publication of same, the Village Administrator shall have the same constructed or repaired at the expense of the property owner. All expenses shall be assessed against the property according to law and such assessment certified by the Fiscal Officer to the County Auditor for collection as other taxes are collected, with a penalty of five percent (5%) and interest in case of failure to pay at the time fixed by the assessing ordinance.
   (b)   The Village Administrator on behalf of the Municipality is hereby authorized to execute contracts for such construction or repair in the manner provided by law.
   (c)   The expense of such improvement, when made by the Municipality, may be paid out of the Street Repair Fund, which Fund shall be reimbursed for such expenditure upon collection of assessments levied for such improvement, or may be paid by issuance of bonds for that purpose.
