905.04 DISTURBANCE AND RESTORATION OF SIDEWALKS, STREETS AND ALLEYS.
    (a)   No one shall be permitted to disturb the surface of any sidewalk or street or alley within the Village without first posting a bond to secure the prompt and proper replacement of said surface to as near its original condition as possible.
   The amount of the bond shall be determined by the Village Administrator after considering the nature and size of the area to be disturbed. The amount of the bond shall not exceed the estimated cost of repair of the area disturbed. The Village Administrator may waive the bond whenever, in his opinion, such bond is not necessary.
   (b)   Before restoring any of the area disturbed, the person doing the work shall notify the Village Administrator as early as possible, so as to allow the Village Administrator to assign someone to inspect the work as it progresses. The owner of the property shall also be required to pay an inspection fee of twenty-five dollars ($25.00) to defray the Village’s cost of conducting said inspection.
   (c)   Bonds posted pursuant to this section shall not be released until such time as the Village Administrator determines that sufficient time has passed without the occurrence of settling or other deterioration in the area disturbed that such settling or other deterioration is unlikely. However, in no event will bonds be retained in excess of one year after the completion of the work. (Ord. 2013. Passed 5-6-96.)
