(A) Bardstown Cable Television shall be operated in complete compliance with all applicable state, federal, and local rules and regulations including, but not limited to, the Cable Communication Policy Act of 1984, the Cable Television Consumer Protection and Competition Act of 1992 and FCC Rules and Regulations.
(B) In accordance with FCC rules and regulations regarding radio frequency (RF) signal leakage, any subscriber with any faulty or damaged apparatus or equipment, whether the faulty equipment is owned by Bardstown CATV or by private owner, affecting the Bardstown Cable Television System whereas found to radiate RF signals above the allowed levels shall:
(1) Take appropriate measures to repair such apparatus in a timely manner upon notification by CATV department personnel, if such equipment is the property of the customer; or
(2) Make arrangements with the CATV department to schedule repairs of such apparatus that is the property of the city.
(C) RF leakage violations, if not addressed in a reasonable amount of time after notice documented by the CATV Department, shall result in termination in cable television services to the location in non-compliance.
