§ 53.123 INDUSTRIAL SURCHARGE RATES.
   (A)   The city shall assess users, who discharge wastewater that differs significantly from domestic wastewater, charges proportionate to the quantity and quality of wastewater discharged. The quantity and quality of the wastewater shall be monitored and analyzed in a manner and at a frequency acceptable to the city, but not less than annually. Separate rates of charge shall be established by the city for costs related to flow volume, BOD, suspended solids, ammonia-nitrogen and for any other parameter established by the city. The following ceiling limits are established: for BOD 1,400 mg/l (milligrams per liter), for TSS 1,400 mg/l, and for Ammonia 140 mg/l.
   Industrial Customer Wastewater Loading Surcharge Rates
No surcharge rate will be charged for wastewater with a strength less than 250 mg/l BOD, 250 mg/l TSS, and 20 mg/l ammonia-nitrogen.

   (B)   Consumer price index adjustment of surcharge rates. In addition to the above rates listed in division (A) for industrial surcharge and the oil and grease surcharge rates listed in § 53.124 below, on July 1 of each year the city may adjust surcharge rates based upon the consumer price index (CPI) for the preceding year. Documentation for the CPI shall be available from the U.S. Department of Labor.
