The following are exempt from all town zoning approval processes and requirements:
(A) A carrier on wheels (COW) may be placed for a period of time up to 60 days within a one-year calendar period only upon properties zoned commercial or governmental within the town or its ETJ or during a declared state of emergency affecting the town as declared by the Governor of the state or the President of the United States;
(B) Ordinary maintenance of existing wireless facilities as defined by this chapter;
(C) Removal or replacement of transmission equipment on an existing wireless tower or base station which does not result in a change in the number of antennas, height of the tower, size of the structure or general appearance of the facility;
(D) Any wireless communication facilities below 65 feet when measured from ground level which is owned and operated by an amateur radio operator licensed by the Federal Communications Commission (FCC) and used exclusively for amateur radio operations;
(E) Satellite dishes;
(F) Removal or replacement of an antenna or equipment on an existing wireless support structure or base station that does not change the physical dimensions of the wireless support structure or base station, or defeat any of the concealment elements of the wireless support structure or base station;
(G) A temporary wireless communications facility if necessary to continue providing service while a wireless support structure or other structure upon which the existing wireless communications facility has been placed, such as a building or water tank, is undergoing maintenance, replacement or reconstruction during which it will be impossible or unsafe to operate the existing wireless communications facility; except that:
(1) The temporary facility must be located on site and no taller than the existing wireless support structure or other structure;
(3) The temporary facility must comply with all federal and state requirements; and
(4) The temporary facility must be removed within 60 days of the conclusion of the maintenance, replacement or reconstruction, or within one year, whichever is shorter, unless the time is extended by the Zoning Administrator for good cause shown as in the use of a carrier on wheels as listed in the definitions in § 153.05 of this chapter.
(H) Public safety facilities or installations required for public safety on public or private property, including transmitters, repeaters and remote cameras so long as the facilities are designed to match the supporting structure.
