§ 130.02 OPEN CONTAINER OF BEER OR ALCOHOL IN PUBLIC PLACES.
   Except as provided in SDCL § 35-1-9.4, it shall be unlawful to drink any beer or alcoholic beverage or to possess any glass, can, or other container containing beer or any alcoholic beverage on which the seal has been broken, in any public place, automobile, street, alley, sidewalk, or place of amusement or business establishment not authorized to sell beer or alcoholic beverages, unless approved by the City Council. PUBLIC PLACE shall mean any place in or out of a building commonly and customarily open to or used by the general public.
