Sec. 16-135. Permits.
   (a)   Persons wishing to engage in activities regulated by this division may do so when a specific permit is approved by the village manager or designee. Applications for such a permit shall be submitted on a form designated by the village, and shall be submitted, except in case of emergency, at least 48 hours prior to the event in question. Applications for such a permit shall include the nature of the event, the time, place, and date of the event. In determining whether to grant such a permit, the village manager or his designee shall take into account the proposed volume, duration, time, location, and other circumstances surrounding the proposed activities. A permit shall not be unreasonably withheld, and may contain appropriate conditions, including limits as to time, place, duration, decibel levels, and manner, designed to minimize disruptive impact from noise generated. Permits for religious or political purposes shall be granted, subject only to reasonable restrictions. Permits issued under this section shall specify that the permission granted shall continue for a stated period, or until revoked after actual notice by the village manager or designee where the activities actually or imminently threaten to cause material and substantial disruption to the community or invasion of the rights of others. Persons shall not be held in violation of this division when acting in conformity with a valid permit issued pursuant to this division, but any permit may be revoked if the village manager or designee determines the authorized activity has resulted in generation of unreasonably loud or disturbing sound levels.
   (b)   In case an application for a permit under this subsection is denied or a permit is granted with conditions unacceptable to the applicant, or a permit is revoked, the applicant or permit holder may be entitled to a prompt but informal appeal hearing before the village manager upon submission of a written request. The decision of the village manager whether to grant an appeal hearing or to reverse, modify, or uphold the challenged action shall be final.
   (c)   The permit fee for a permit issued pursuant to this section shall be $25.00 and shall be paid to the village upon issuance of the permit.
