§ 70.999  PENALTY.
   (A)   Whenever in this chapter an act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or whenever in this chapter the doing of any act is required or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any such provision of this chapter shall be subject to punishment as provided in § 10.99 of this code; provided, however, if the maximum penalty provided by this chapter for any such offense is greater than the maximum penalty provided for the same or a similar offense under the laws of the state, then the maximum penalty for violation as provided by state statute shall be the maximum penalty under this chapter.
   (B)   A person determined to be in violation of § 70.020 shall be fined, upon conviction, not less than $50 and not more than $500.
   (C)   To the extent that the conduct is not already covered by the Texas Penal or Transportation Codes:
      (1)   The penalty for any violation of § 70.084 that causes injury to a vulnerable road user shall be a fine not to exceed $500.
      (2)   The penalty for violations of § 70.084(C) or (D) which do not result in injury shall be a fine not to exceed $500.
      (3)   The penalty for any violation of § 70.084 other than of divisions (C) and (D) which does not cause injury to a vulnerable road user shall be a fine not to exceed $200.
   (D)   Any person convicted of any violation of §§ 70.095 through 70.098 of this chapter shall be guilty of a Class C misdemeanor and shall be penalized by a fine of no more than $500. Upon the first offense only, the fine may be waived if the person owns or has acquired a helmet prior to the court hearing and promises the court that the helmet will be used in the future.
   (C)   Any person, firm or corporation violating any of the provisions of § 70.110 of this chapter shall be deemed guilty of a misdemeanor and shall, upon conviction, be fined in any amount not to exceed $200. Each violation shall be a separate offense.
