For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BICYCLE. A human-powered vehicle with two wheels designed to transport, by a pedaling action, a person seated on a seat.
CHILD. Any individual less than 16 years of age.
HELMET. Properly-fitted headgear that is not structurally damaged and that conforms to the standards or the American National Standards Institute, the American Society for Testing and Materials, the Snell Memorial Foundation or any federal agency having regulatory jurisdiction over bicycle helmets at the time of the manufacture of the helmet.
MOTORIZED SCOOTER. A self-propelled device with at least two wheels in contact with the ground during operation, which may have a gas or electric motor of 40 cubic centimeters or less, and which is designed to allow a person to stand or sit while operating the device, and has the ability to be propelled by human power alone.
PARENT. The natural or adoptive parent, court-appointed guardian or conservator of the child.
PUBLIC WAY. Any property located within the city that is publicly owned or maintained, including, but limited to, a publicly-owned or maintained street, access road, highway or alley.
WEARING A HELMET. Properly-fitted headgear is properly attached to a person’s head with the chinstraps of a helmet securely fastened and tightened in the manner intended by the manufacturer to provide maximum protection.
