As used in this chapter:
(a) "Aquatic (pool) management" means that person or their duly designated assistants who has been so designated by the Mayor and Council.
(b) "Guest" means any bona fide guest of a resident or pass holder.
(c) "Immediate family" means parents, spouse or dependent children.
(d) "Pool management" means the individual employees of the City who exercise supervisory powers at the aquatic facility under authority established by Council.
(e) "Nonresident employee" means a full-time, part-time, or seasonal employee of any business operating within the geographical boundaries of the City. Such worker would be paying income tax to the City.
(f) "Resident" means any natural person who has a bona fide domicile in the City.
(g) "Swimming pool facilities" means that portion of the City owned property adjacent to the City property known as Avon Aquatic Facility such facilities consisting of, among other things, the main pool, bath house, wading pool, lawns, parking area, roadways and walks.

(a) The use of the swimming pool facilities shall be subject to such rules and regulations as may from time to time be promulgated by the City's Aquatic (Pool) Management and filed with the Mayor and Clerk of Council. A copy of such rules and regulations shall be available for public inspection and posted in a conspicuous place at the Aquatic (Pool) Facility.
(b) Such rules and regulations shall be enforced by the Police Department and by supervisory aquatic facility personnel employed by the City. Any violations of said rules and regulations are punishable as set forth in Section 1065.99 herein.

The swimming pool facilities shall be open on such days and during such hours as are determined by the City's Aquatic (Pool) Management, and no person not specifically authorized by Management shall enter upon or use the facilities except upon such days and within such hours. A copy of the pool times of operation will be filed with the Mayor and Clerk of Council. All other days and hours of use are strictly prohibited. Certain pool sections may be closed or shared with other activities at the discretion of Management. A copy of the times of operation shall be made available for public inspection and posted by Aquatic (Pool) Management in a conspicuous place at the swimming pool facility.

(a) The fees for admission to the swimming pool facility are governed by Ordinance No. 45-15, passed April 13, 2015, set forth in Chapter 210 of these Codified Ordinances. The use of the swimming pool facilities shall, because of limited accommodations, be limited as set forth therein. Any unauthorized entry into the swimming pool facility shall be considered at a minimum to be a trespass and punishable in accordance with Part Six of these Codified Ordinances.

The Mayor or the Aquatic (Pool) Management or one of their designees, may close the swimming pool facilities whenever, in their judgment, such action is deemed necessary or desirable for the protection of the health, safety or welfare of the residents or guests entitled to use the swimming pool facilities, or for the protection of the health, safety or welfare of the people of the City at large. Such action shall not entitle the holders of any admission tickets to a refund.

The Mayor or the Aquatic (Pool) Management or one of their designees, any member of the Police Department or any other person authorized by the Mayor shall have the power and authority to prohibit any action or conduct which they consider dangerous, improper or immoral or in violation of any rule or regulation promulgated by the Aquatic (Pool) Management or in contravention of this chapter. They shall have the power to suspend the privileges otherwise granted to the holder of any admission ticket, remove them from the premises or take other action authorized by this chapter. Anyone expelled from the swimming pool facility pursuant to this section shall not be entitled to a refund.

Whoever violates any provision of this chapter, not otherwise provided for in these Codified Ordinances, is guilty of a minor misdemeanor on their first offense and shall be fined not more than one hundred and fifty dollars ($150.00). Anyone found to have violated any provision of this chapter a second or subsequent time, not otherwise provided for in these Codified Ordinances, is guilty of a fourth degree misdemeanor and may be fined not more than two hundred and fifty dollars ($250.00) and imprisoned for not more than 30 days.
