(a) No more than five (5) years from the year in which the Charter was last reviewed, a Charter Review Commission consisting of nine (9) members and two (2) alternates all of whom must be electors of the City of Avon and holding no elective office with the City of Avon shall be selected pursuant to subsection (c). One (1) Alternate shall be designated “Alternate A” and the other as “Alternate B”. These alternates shall not be voting members of the Charter Review Commission unless called upon to fill in for an absent regular member. When such absence occurs causing a temporary vacancy to exist on the Commission, the Chairman will designate one (1) of the Alternates to fill in as a full voting member for that meeting only. The Chairman will rotate among the two (2) Alternates, beginning with Alternate “A”, each time there is a temporary absence. When a permanent vacancy exists on the Commission, an Alternate, beginning with Alternate “A”, will be designated to permanently fill the vacancy. If membership on the Charter Review Commission falls below seven (7) members after the installation of the two (2) Alternates, the Commission is deemed dissolved. Any items approved by the Commission prior to the dissolution will be submitted to City Council for presentation to the electors as hereinafter set forth in subsection (b).
(b) The Charter Review Commission and Alternates A and B, as selected by the Selection Committee in subsection (c), shall be seated by City Council on or before January 31 of that succeeding year. Should City Council fail to act prior to January 31, the Selection Committee's appointments will be deemed seated as of that date. The Commission shall meet the first Thursday in February, for a period not to exceed one hundred fifty (150) days. During this period, the Commission may recommend to Council such alterations, revisions and amendments, if any, to this Charter, as in its judgment are desirable. The Council shall submit to the electors not later than the next succeeding November election each such proposed alterations, revisions or amendments. The members appointed to said Commission, including alternates, shall serve without compensation. Meetings of the Charter Review Commission shall be open to the public.
(c) A permanent Charter Review Commission Selection Committee is hereby established to review all applicants to the Charter Review Commission and to select from those applicants individuals most appropriate for appointment to the Charter Review Commission. The Selection Committee shall consist of five (5) members. These members shall be as follows: the City’s Planning Commission Chairman, Board of Zoning and Building Appeals Chairman, two (2) members of City Council to be selected by City Council and the Mayor or the Mayor’s designee who shall not be an elected official. All applicants for positions on the Charter Review Commission must submit their applications on or before November 1st in the year preceding the seating of the Charter Review Commission. The Selection Committee shall inform Council, in writing, of their selections on or before the last regular meeting of Council of that same year. The Selection Committee must insure that all Wards within the City are represented. No more than one (1) member from the same immediate family (i.e., spouse, children, siblings) or household will be permitted to be seated on either the Selection Committee or the Charter Review Commission. The Selection Committee is encouraged to strive for balance with the goal of achieving as diverse a cross-section of the community as possible.
