Section 3.   Duties.
   The Civil Service Commission, through the home rule powers of the City of Avon, is expressly authorized to provide by rule for the ascertainment of merit and fitness as the basis for appointment and promotion in the service of the Municipality. These rules shall establish the basis and method for determination of eligibility, certification, selection, appointment and promotion of candidates for positions in the classified service. They shall also establish rules for appeals from the action of the Mayor or any director in any case of transfer, reduction or removal. The action of the Commission on any such appeal shall be final. The Commission shall keep a record of all its proceedings. Any rules, including but not limited to those pertaining to testing of applicants for entry level positions or for promotions within the ranks, as well as the selection of those so tested, duly adopted by the Civil Service Commission pursuant to the Rules of the Commission are hereby deemed valid as a proper exercise of the City's home rule powers and shall supersede the requirements of any conflicting general laws of the State of Ohio or any conflicting legislation adopted by City Council, and shall only conform to the requirements of the Ohio Constitution. Civil Service examination shall not be required for the following:
   (a)   The appointment of any member of a board or commission;
   (b)   The appointment of a director of a department;
   (c)   The appointment of a secretary or stenographer to a director;
   (d)   The appointment of a Secretary to the Mayor;
   (e)   The appointment to any other office or position requiring peculiar and exceptional qualifications.
   Any person who shall have served this Municipality for at least thirty (30) days next preceding the taking effect of this Charter may be retained in the same or any similar position without examination. Except as herein provided, the Civil Service Commission shall determine the practicability of competitive examination for any non-elective office or job classification in the service of the Municipality. The Director of Finance shall not pay any salary or compensation to any person holding a position under the jurisdiction of the Civil Service Commission until the Director of Finance receives a certificate from the Civil Service Commission for such person stating that the person has been properly employed, the proper position and grade for such person, and the proper rate of salary or compensation to be paid to such person. A new certificate shall only be required for a person when there is a change in the position, grade, or rate of salary or compensation for such person. Any sum paid in the absence of such certificate may be recovered by the Municipality.
