§ 96.03 TRIMMING OF TREES BY PROPERTY OWNER; RESTRICTED GROWTH.
   (A)   All shade trees in the town which are six inches in diameter at a point two feet above the ground, and which are situated between the outer edge of the sidewalk and the curb line in any street in the town, or which are situated upon any lot or parcel of land in the town so near the line of the street that the boughs thereof shall overhang the sidewalk of the street shall be trimmed by the owner or owners of the lot or parcel of land abutting on the street where any of the shade trees may be situated, or of the lot or parcel of land upon which the shade trees may be situated, so that the lowest foliage thereof shall be at least ten feet above the surface of the street and shall be trimmed under and in accordance with the directions of the Town Marshal.
   (B)   All shade trees situated between the outer edge of the sidewalk and the curb line in any street in the town, or which are situated upon any lot or parcel of land in the town so near the line of the street that the boughs thereof shall overhang the sidewalk and the used portion of the street shall be trimmed by the owner or owners of the lot or parcel of land immediately abutting the street wherein the shade trees may be situated, or of the lot or parcel of land upon which shade tress may be situated, so that the limbs, boughs and foliage thereof do not obstruct or in any manner hinder travel or traffic upon the street or in any manner obstruct or prevent the light from any public street lamp from falling upon the street in the town, and the shade trees shall be so trimmed under and in accordance with the directions of the Town Marshal.
   (C)   Any person, firm or corporation owning any lot or parcel of land in the town whereon any shade tress are growing or abutting on the unused portion of any street in the town whereon shade trees have been planted and are growing as described herein, who shall fail to keep the trees trimmed in accordance with the provisions of this chapter, or fail or refuse to trim the trees after five days written notice has been given him or her by the Town Marshal, then the Marshal shall cause the trees to be trimmed in the manner provided in this chapter, and the cost, charges and expenses thereof shell be a lien upon the lot or parcel of land, and shall be collected in the same manner as assessments of street improvements.
