§ 51.101  REMEDIES FOR PROHIBITED DISCHARGES; AUTHORITY OF WASTEWATER SUPERINTENDENT.
   (A)   If any waters or wastes that contain the substances or possess the characteristics enumerated in § 51.100 are proposed to be discharged to the public sewers, the Wastewater Superintendent may do the following:
      (1)   Reject the wastes in whole or in part;
      (2)   Require pretreatment of the wastes as necessary to comply with the limitations defined in this chapter; and
      (3)   Require payment of a surcharge on any excessive flows or loadings discharged to the treatment works to cover the additional costs of having capacity for the treating of the wastes.
   (B)   If the Wastewater Superintendent permits pretreatment or equalization of wastes, or equalization of waste flows, the industrial user must develop and submit a compliance schedule for the design and installation of the technology required to meet applicable pretreatment standards. The compliance schedule, design, and equipment shall be subject to the approval of the Wastewater Superintendent and subject to the requirements of all applicable codes, ordinances, and laws.
