The Wastewater Superintendent shall prepare, for passage by the City Council, an Enforcement Response Guide (ERG) to ensure that the requirements of 40 C.F.R. 125.120 through 125.140, and § 403 of the Clean Water Act, being 42 U.S.C. § 1343, will be met. The ERG shall outline various administrative actions the Wastewater Superintendent may take for various pretreatment violations. The maximum fine shall be $1,000 per violation. The Wastewater Superintendent shall review and update, on an annual basis, for the City Council any changes needed to ensure compliance with the federal, state and local pretreatment regulations as listed in the act and this chapter.
