612.09 POSSESSION OR USE ON CITY PROPERTY.
(a) No person shall sell, possess, consume or use beer, wine, mixed beverages, or spirituous liquor on any property owned by the City.
(b) Notwithstanding the provisions of subsection (a) of this section, the sale, possession, consumption, or use of beer, wine, mixed beverages or spirituous liquor may be permitted on city property by the Mayor after a review and recommendation by the Police Chief upon the filing of an application by any nonprofit organization ("applicant") sponsoring an event in accordance with the following:
(1) Said application shall identify the sponsoring entity, identify an individual person responsible for receiving all communications from the City, specify the date and time of the proposed event, agree to be responsible for the cost of any police protection necessary (unless waived by the City) and agree to indemnify and hold the City harmless from any and all liability in connection with the serving and the use of beer, wine or alcoholic beverages on the property during the event. The applicant must then present documentation that the organization has a valid liability insurance policy to protect the City and the organization(s) from liability.
(2) The Mayor may direct the Police Chief to investigate the applicant to determine whether there is any history of past criminal violations.
(3) Upon receipt of said application and a payment of a filing fee of twenty-five dollars ($25.00) (which shall be used to process said application), if the Mayor is satisfied that the applicant seeking said permit is a responsible community organization and that the venue to be used for the event is appropriate, the Mayor shall issue a permit for possession, consumption, or use of beer, wine, mixed beverages or spirituous liquor on City property for the duration of said event.
(4) If the permit being sought includes the sale of beer, wine, mixed beverages or spirituous liquor on City property, the applicant seeking such permit must first comply with all requirements of the State Department of Liquor Control and present proof of such compliance to the Police Chief as a prerequisite to the issuance of a permit.
(c) Whoever violates this section shall be guilty of a minor misdemeanor.
