644.02 PANHANDLING.
   (a)   No person shall panhandle after sunset or before sunrise.
   (b)   No person shall knowingly make any false or misleading representation in the course of panhandling.
   (c)   It shall be unlawful to engage in the act of panhandling when either the panhandler or the person being solicited is located within twenty-five (25) feet of any of the following locations:
      (1)   Any intersection, streets or crosswalks or intersecting streets and crosswalks;
      (2)   Any street or driveway entrance to or exit from shopping plazas, shopping districts, any commercial or business establishments, churches or public or private schools or libraries;
      (3)   Any bus stop;
      (4)   Any automatic teller machine or bank;
      (5)   Any sidewalk cafe or outdoor cafe or restaurant;
      (6)   Any driveway entrances to or exits from an automobile service station;
      (7)   When the person being panhandled is in any public transportation vehicle or public transportation facility; or
      (8)   On any privately-owned property where the owner or other party in control of the property has posted in a conspicuous place a notice or sign indicating that panhandling is not allowed on the privately-owned property. (Ord. 2014-118. Passed 10-13-14.)
