921.03 PRIVATE SEWAGE SYSTEMS.
(a) Where a public sanitary or combined sewer is not available under the provisions of Section 921.02(d), the building sewer shall be connected to a private sewage disposal system complying with the provisions of this chapter.
(b) Before commencement of construction of a private sewage disposal system, the owner shall obtain a written permit from the County Board of Health for private premises and from the Ohio Department of Health for semipublic premises.
(c) The type, capacity, location and layout of a private sewage disposal system shall comply with all requirements of the County Board of Health and the Ohio Department of Health.
(d) At such time as a public sewer becomes available to a property served by a private sewage disposal system, as provided in Section 921.02(d), a direct connection shall be made to the public sewer within ninety days in compliance with this chapter, and any septic tanks, cesspools and similar private sewage disposal facilities shall be abandoned and filled with suitable material in accordance with the requirements of the County Board of Health.
Upon request of an affected property owner, the Director of Engineering, Utilities and Inspection may extend the aforesaid ninety-day period for connection for up to three years; provided that he determines:
(1) That the private sewage disposal system is functioning properly:
(2) That no health problem is connected with the continuance of the private sewage disposal system for the entire period of the requested extension; and
(3) That the extension is not in conflict with a previous determination by Council of the necessity for such newly available public sewer.

(e) The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times at no expense to the City.
(f) No statement contained in this chapter shall be construed to interfere with any additional requirements that may be imposed by the County Health Officer.
