921.01 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context specifically indicates otherwise.
   (a)   "Act" means the Federal Water Pollution Control Act, as amended by the Clean Water Act and the Water Quality Act of 1987 (33 U.S.C. 1251 et. seq.).
   (b)   "Applicable Pretreatment Standard" means any pretreatment standard or requirement (Federal, State and/or local), with which users are required to comply.
   (c)   "Authority" means the City of Aurora.
   (d)   "Biochemical Oxygen Demand (BOD) or BOD5" means the quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five (5) days at 20C (20 degrees Centigrade) expressed in terms of weight and concentration. The oxygen demand measured is the sum of carbonaceous and nitrogenous demands. Laboratory procedures shall be in accordance with the latest edition of Standard Methods for the Examination of Water and Wastewater, as defined in this section.
   (e)   "Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet (1.5 meters) outside the inner face of the building wall.
   (f)   "Building sewer" means the extension from the building drain to the public sewer or other place of disposal.
   (g)   "Bypass" means the intentional diversion of wastestreams from any portion of the pretreatment facility.
   (h)   "Categorical Pretreatment Standard" means the same as “National Categorical Pretreatment Standard”.

   (i)   "City Engineer" means the Director of the City Division of Engineering, Inspection and Utilities, or his authorized representative.

   (j)   "Combined sewer" means a sewer receiving both surface runoff and sewage.
   (k)   "Cooling water" means the water discharged from any system of condensation, air conditioning, cooling, refrigeration or other, which is free from odor and oil. It shall contain no polluting substance which would produce BOD or suspended solids each in excess of ten parts per million by weight.
   (l)   "Discharger" means the same as Industrial User.
   (m)   "Garbage" means solid wastes from the domestic and commercial preparation, cooking and dispensing of food and from the handling, storage and sale of produce.
   (n)   "Indirect Discharge or Discharge" means the introduction of pollutants into the Water Pollution Control Facility from a non-domestic source regulated under 307(b), (c) or (d) of the Act.
   (o)   "Industrial User, or User" means a source of Indirect Discharge.
   (p)   "Industrial Waste/Industrial Wastes" means any substance including liquid wastes, resulting from any process of industrial, commercial, governmental and institutional concerns, manufacturing, business, trade, or research, including the development, recovery, or processing of natural resources, or from sources other than those generating waste defined as normal domestic sewage herein.
   (q)   "Interference" means a discharge which, alone or in conjunction with a discharge or discharges from other sources, both: (1) inhibits or disrupts the POTW, its treatment processes or operations, or its sludge processes, use or disposal; and, (2) therefore is a cause of a violation of any requirement of the POTW's NPDES Permit (including an increase in the magnitude or duration of a violation) or of the prevention of sewage sludge use or disposal.
   (r)   "Law Director" means the Director of Law of the City, or his authorized deputy, agent, or representative.
   (s)   "May" is permissible.
   (t)   "National Categorical Pretreatment Standard or Categorical Pretreatment Standard" means any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Section 307(b) and (c) of the Act (33 U.S.C. 1347) which applies to a specific category of industrial users.

   (u)   "Normal sewage" means as defined in Exhibit "A" attached to Ordinance 1997- 224.

   (v)   "National Pollutant Discharge Elimination System (NPDES) Permit" means a permit issued by the State of Ohio EPA or United States EPA pursuant to the Act for the purpose of regulating the discharge of sewage, industrial wastes, and other wastes under the authority of Section 402 of the Act, into the navigable waters of the United States.
   (w)   "Natural Outlet" means any outlet into a watercourse, pond, ditch, lake or other body of surface or ground water.
   (x)   "New Source" means any building, structure, facility or installation from which there is or may be a discharge of pollutants, the construction of which commenced after the publication of proposed pretreatment standards under Section 307(C) of the Act which will be applicable to such source if such standards are thereafter promulgated in accordance with that section, provided that: (1) The building, structure, facility or installation is constructed at a site at which no other source is located; (2) The building, structure, facility or installation totally replaces the process or production equipment that causes the discharge of pollutants at an existing source, or, (3) The production or wastewater generating processes of the building, structure, facility or installation are substantially independent of an existing source at the same site.
   (y)   "Pass Through" means a discharge which exits the POTW into waters of the United States in quantities or concentrations which, alone or in conjunction with a discharge or discharges from other sources, is a cause of a violation of any requirement of the POTW's NPDES Permit (including an increase in the magnitude or duration of a violation).
   (z)   "Person" means any and all persons, natural or artificial, including any individual, firm, company, private corporation, partnership, co-partnership, joint stock company, trust, association, institution enterprise, or other legal entity, or their representatives, agents, or assigns. The masculine gender shall include the feminine. The singular shall include the plural where indicated by the context.
   (aa)   "pH" means the logarithm, base ten, of the reciprocal of the hydrogen concentration expressed in moles per liter.
   (bb)   "Properly shredded garbage" means the preparation, cooking and dispensing of food that has been shredded to such degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than one-half of an inch in any dimension.
   (cc)   "Publicly Owned Treatment Works or POTW" means treatment works which are owned by the City, including the sewers, pumping stations, treatment facility, and any related appurtenances.
   (dd)   "Public sewer" means a sewer in which all owners of abutting properties have equal rights and is controlled by public authority.
   (ee)   "Pretreatment" means the process of reducing the amount of pollutants, eliminating pollutants, or altering the nature of pollutant properties in wastewater prior to introducing such pollutants into the City's wastewater disposal system. The reduction, elimination, or alteration may be obtained by physical, chemical, or biological processes, process changes or other means, except as prohibited by this chapter.
   (ff)   "Sanitary Sewer" means any pipe, conduit, ditch, or other device used to collect and transport sewage from the generating source including combined sewers, and to which storm, surface and ground waters are not intentionally admitted.
   (gg)   "Director of Engineering, Utilities and Inspection" means the Director of Engineering, Utilities and Inspection of the City, or his authorized deputy, agent, or representative.
   (hh)   "Sewage" means a combination of water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground, surface and storm waters as may be present.
   (ii)   "Sewage treatment plant" means any arrangement of devices and structures used for treating sewage.
   (jj)   "Sewage works" means all facilities for collecting, pumping, treating, and disposing of sewage.
   (kk)   "Sewer" means any pipe, conduit, ditch or other device used to collect and/or transport sewage.
   (ll)   "Shall" is mandatory.
   (mm)   "Significant Industrial User or SIU" includes the following: (1) all Industrial Users subject to categorical pretreatment standards; and (2) any other Industrial User that: discharges an average of 25,000 gallons per day or more of process wastewater to the POTW; contributes a process wastestream which makes up 5 percent or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant; or has a reasonable potential, in the opinion of the Director of Engineering, Utilities and Inspection, to adversely affect the POTW's operation or for violating any pretreatment standard or requirement.
   (nn)   "Sludge" means any solid, semi-solid, or liquid waste generated by a municipal, commercial, or industrial wastewater treatment plant, water supply treatment plant, or air pollution control facility or any other waste having similar characteristics and effects.
   (oo)   "Slug or Slugload" means any pollutant, including oxygen demanding pollutants (BOD, etc.) released in a discharge at a flow rate and/or pollutant concentration which will cause Interference with or Pass Through the POTW.
   (pp)   "Storm drain/Storm sewer" means a sewer which carries storm and surface waters and drainage, but excludes sewage and industrial wastes, other than unpolluted cooling water
   (qq)   "Suspended Solids" means solids that either float on the surface of, or are in suspension in, or will settle in water, sewage, or other liquids or industrial waste, and which are removable by a laboratory filtration device. Quantitative determination of suspended solids shall be made in accordance with procedures set forth in Standard Methods.
   (rr)   Unpolluted water or waste" means any water or waste containing none of the following: free or emulsified grease or oil; acid or alkali; phenols or other substances imparting taste and odor in receiving waters; toxic or poisonous substances in suspension, colloidal state or solution; and noxious or odorous gases. It shall contain not more than 10,000 mg. per liter by weight of dissolved solids, of which not more than 2500 mg. per liter shall be as chloride, with permissible volume subject to review by the Director of Engineering, Utilities and Inspections, and not more than ten mg. per liter each of suspended solids and BOD. The color shall not exceed fifty mg. per liter.
   (ss)   "Upset" means an exceptional incident in which a Discharger unintentionally and temporarily is in a state of noncompliance with Pretreatment Standards due to factors beyond the reasonable control of the discharger, and excluding noncompliance to the extent caused by operational error, improperly designed treatment facilities, inadequate treatment facilities, lack of preventive maintenance, or careless or improper operation thereof.
   (tt)   "User" means the same as “Industrial User”.
   (uu)   "Watercourse" means a channel in which a flow of water occurs, either continuously or intermittently.
   (vv)   "Wastewater Discharge Permit or Industrial Discharge Permit" means a formal permit to discharge industrial waste into the POTW, as issued by the City.
