761.99 PENALTIES.
    (a)   For any act or omission which constitutes a violation of this chapter, the licensed
vendor shall be punished as follows:
 
First offense within five years
3 day license suspension (including the privilege of selling tobacco products)
Second offense within five years
5 day license suspension (including the privilege of selling tobacco products)
Third offense within five years
10 day license suspension (including the privilege of selling tobacco products)
Fourth offense within five years
Permanent termination of license (including the privilege of selling tobacco products)
    (b)   If a cigarette and tobacco vendor's license is suspended for any period of time, or terminated, pursuant to this section, the Chief of Aurora's Police Department shall forthwith send, by certified mail, return receipt requested, a certified copy of the order of suspension to the vendor, addressed to the vendor at the premise stated in such license. The vendor, upon receiving such notice of suspension shall forthwith surrender the license to the Chief of Aurora's Police Department. The Chief of Aurora's Police Department shall retain the license in his/her possession until the termination of the period of suspension, when the license, if not terminated or expired, shall forthwith be returned to the vendor. During the period of suspension, the Chief of Aurora's Police Department shall not issue a new license for the vendor's premise and any license issued for the premise shall be void.
