§ 33.05 VACATION; COMPENSATORY TIME; PERSONAL DAYS.
   (A)   Vacation benefit policy. The vacation policy of the city Police Department shall be as set forth hereinafter and is based on a 40-hour work week even if officers work an average in excess of 40 hours per week:

   (B)   Non-Family and Medical Leave Act (FMLA); sick leave.
      (1)   The city provides paid sick leave benefits to all regular full-time employees for periods of temporary absence due to illness or injuries. The employees will earn sick leave at the rate of six days per year.
      (2)   Sick leave is to be used for the following reasons only:
         (a)   Injury or illness of the employee; and
         (b)   To avoid jeopardizing the health of other employees.
      (3)   Employees can accrue sick leave up to 90 days in order to provide income assistance for illness or injury. Sick time shall be taken in no less than four hour increments.
      (4)   Employees will notify their supervisor of absence due to sickness at least three hours before the beginning of their shift or regular work hour, or no later than one hour under mitigating circumstances. The supervisor shall also be informed by the employee on each subsequent day of sickness and shall be kept informed as to the extent of the illness and the anticipated day of return to work.
      (5)   Employees will be required to provide a physician's certification of illness and the ability to resume work for sick leave after three days. If an employee is off work because of illness and the sick leave runs out, the department head should contact the Board of Works in order to obtain an extended leave of absence and to make continued arrangements for continued insurance coverage.
      (6)   Supervisors shall keep documented records of absences whether they are reported or not. Unreported absences due to alleged sickness will result in disciplinary action. Any other abuses of sick leave may also result in disciplinary action.
      (7)   Sick leave benefits will be calculated on the basis of the employee's base pay rate at the beginning of the absence and will not include any special forms of compensation such as shift differentials. An employee's base pay rate is determined by dividing the weekly rate of pay by the hours normally worked.
      (8)   Vacation or personal time may be used to supplement sick leave, but sick leave may not, under any circumstances, be used to supplement or add to vacation or personal time.
      (9)   The Clerk-Treasurer must be provided a written report of the employee sick days used each pay period.
      (10)   Sick pay incentive plan. The city agrees to pay a $500 bonus to any police employee that misses zero sick time during the calendar year. The employee cannot report to work sick in order to collect the bonus.
      (11)   “Line of duty” injuries are exempt from aforementioned policies subject to review and approval by Board of Public Works.
   (C)   Compensatory time policy. Compensatory time off shall be accumulated to increments of eight hours after which the member of the Police Department accumulating compensatory time shall be paid the equivalent of one 8-hour day of compensatory time, provided that the provisions of § 33.04(E) have been met.
   (D)   Personal day benefit policy. Police officers shall be permitted to take six paid days per year as personal days at 12 hours of pay, but shall take no more than one such personal day per month. These personal days are non-cumulative from year-to-year. Dispatchers shall be permitted to take 12 paid days per year as personal days at eight hours of pay, but shall take no more than one such personal day per month. These personal days are non- cumulative from year to year.
   (E)   Holiday pay. Members of the Police Department shall receive holiday pay as follows: If officer is working, the officer is paid at one and one-half hours regular rate of pay. If officer is not working, the officer is paid at regular rate of pay for eight hours for the following holidays:

   (F)   Termination or resignation. Termination or resignation results in a loss of unused sick or personal days. Vacation days are prorated to the date of termination or resignation.
   (G)   Salary review policy. All police and communications officers salaries are reviewed during the annual budget process set by the city, and upon approval are effective at the beginning of the next city fiscal year beginning January 1.
      (1)   Cost of living adjustment policy (across-the-board adjustments). Each police and communications officer may automatically receive an increase in salary as determined by the city for all city employees for cost of living.
      (2)   Merit pay increase benefit policy. In addition to across-the-board adjustments, each police and communications officer may receive an additional increase of 2% of his/her base pay for exceeding expectations in job performance and 3% of his/her base pay for outstanding job performance as determined by the Chief of Police and reviewed by the Board of Public Works and Safety.
      (3)   Change in job responsibility. A police or communications officer's salary may be reviewed upon any change in job responsibility deemed significant by the Police Chief to warrant a review before the annual budget process.
   (H)   (1)   To encourage city residency for Police Officers employed by the city, a housing benefit payment will be made available to those officers interested in purchasing a home within the incorporated limits of the city. A one-time cash benefit of $5,000 will be made available at closing of the purchase of a home of primary residence. The benefit is forgivable pro-rata at $1,000 per year and must be paid back to the city by the officer when the home ceases to become a primary residence, at the time of sale of the property withing five years from the date of purchase or the officer ceases employment with the City Police Department.
      (2)   At the end of the first five-year period, the officer may then apply for an additional benefit of up to $5,000 to be applied toward a lump-sum principal payment on any remaining mortgage balance. The benefit is forgivable pro-rata at $1,000 per year and must be paid back to the city by the officer when the home ceases to become a primary residence, at the time of sale of the property within five years from the date of purchase or the officer ceases employment with the City Police Department.
      (3)   In addition to a cash housing benefit, the Board of Public Works may also consider a forgivable land grant benefit to those officers interested in participating in the construction of a new home of primary residence on a city owned property that may be available for an “in-fill” housing construction project to achieve neighborhood revitalization goals and objectives.
