§ 33.04 SALARY; LONGEVITY PAY AND COMPUTATION OF OVERTIME.
   (A)   Police officer pay is based on performance of duty (merit), education, and longevity of service to the citizens and the city Police Department.
   (B)   The base salary shall be paid weekly by the Clerk-Treasurer to each designated payee as mutually determined between said payee and the Clerk-Treasurer.
   (C)   Merit pay increases will be based on the performance evaluations conducted in April and October of each year, using the standardized performance evaluation form. The evaluation process considers overall job performance with consideration given to the difficulty of the work assignments or particular cases assigned. Merit increases are warranted only when the police and communications officer's overall performance and evaluation for the preceding year exceeds expectations or is outstanding.
   (D)   There is hereby established longevity pay for those patrol officers of the city who are uniformed officers covered under the Police Pension Fund and for communications officers with the Police Department. Such longevity shall be paid semi-annually and shall be determined in the following manner:

   Such percentages shall be based upon the income of the employee eligible to receive longevity pay for the 26 weeks prior to the pay date.
   (E)   (1)   A 28 day work period has been established for the purpose of overtime pay computation. This arrangement is in accordance with Section 7(k) of the Fair Labor Standards Act (FLSA).
      (2)   All compensable time worked in excess of 171 hours in the established 28 day work period shall be compensated on an overtime basis or the percentage of hours per pay period for the equivalent thereof. The Chief of Police is responsible for scheduling officer’s shifts and may schedule officers in 8, 10 or 12 hours or other shifts so long as there is compliance with the provisions of the FLSA. For example, during a two-week period, for 12-hour shifts, hours in excess of 85 hours shall be paid at one and one-half times the regular rate of pay.
      (3)   Compensatory time off may be given by the city in lieu of monetary overtime compensation in accordance with Section 7(k) and 7(o) of the FLSA.
      (4)   Compensatory time will be earned at the rate of one and one-half hours for each hour worked over 171 hours in the 28 day work period established herein or the percentage of hours per pay period for the equivalent thereof.
      (5)   The Chief of Police is authorized to enforce that no accumulation of compensatory time in excess of 24 hours per officer is permitted. Pursuant to Section 7(o)(4) of the FLSA, upon termination from employment, the employee shall be paid for unused compensatory time at a rate of compensation that is the higher of (a) the average regular rate of the employee during the last three years of employment or (b) the final regular rate of the employee.
      (6)   This arrangement shall apply only to employees of the city Police Department who are not otherwise exempt from overtime pay provisions of the FLSA, and who are engaged in law enforcement activities as defined in the regulations of the Department of Labor.
      (7)   Civilian employees of the Police Department, namely communications officers, are not considered to be engaged in law enforcement activities and shall therefore be paid overtime for hours worked over 40 hours in a seven day work period.
      (8)   The civilian employees, the dispatchers, in the past, have not been allowed compensatory time off in lieu of monetary payment for overtime hours.
      (9)   The civilian employee, including dispatchers, shall be paid on a cash basis at the rate of one and one-half the employee's regular hourly rate, for hours worked over 40 hours in a seven day period.
      (10)   Compensatory time off will not be allowed the civilian employees, including communications officers, of the Police Department.
      (11)   With prior approval from the Chief of Police, police officers will earn a minimum of two hours compensatory time for court appearances and meetings with the prosecutor, if the officer is not scheduled to work a normal shift on that date.
   (F)   The base salary for the fiscal year beginning January 1, 2018 of the following police and communications officers should be and is hereby fixed and determined as follows:
