§ 97.42  STORAGE OF PETROLEUM PRODUCTS; PERMITS.
Any person, firm or corporation desiring to have or keep a storage tank either above ground or below ground for the purpose of storing over ten gallons of gasoline, oil, grease, distillate or petroleum products must first get permission from the City Council. The City Council shall require the name of the product to be stored, the place of storage and the amount of product stored. If permission is granted, the City Council shall prescribe rules, regulations and precautionary actions as it may deem necessary. The provisions of this section shall apply to all property zoned residential within the city limits. A storage tank is different from a usage tank. A usage tank is a tank that is directly connected to the item that uses the product, such as a tank that is directly connected to a furnace or a tank that is directly connected to a generator. A storage tank is a tank that is not directly connected to the ultimate machine or device that uses the product. This section shall not apply to the storage of ten gallons or less of gasoline.
