(A) It shall be unlawful for any person owning or controlling any lot, lots or lands within the fire limits of the city to cause any structure to be built, altered, enlarged or moved upon the lot, lots or lands unless the person shall have first made application therefor to the City Council and shall have received, from the City Council, a building permit authorizing the person to build, alter, enlarge or move the structure. Printed applications for the permits shall be issued by the City Clerk and shall require, in writing, information as the City Council shall deem necessary in order to determine whether or not to grant and issue the building permit.
(B) The City Council shall not hereafter approve or authorize the building, alteration, enlargement or moving of any structure upon any lot, lots or lands within the fire limits of the city, unless the structure is designed to be enclosed with the incombustible materials as shall, to the satisfaction of the City Fire Chief cause the structure to be reasonably fire proof. The City Council shall not hereafter approve or authorize the building or construction of any buildings, sheds or structures, known as ironclads, constructed of wood and covered with sheet iron or tin attached to the wooden frame upon any lot, lots or lands within the fire limits of the city. The City Council shall not hereafter approve or authorize the building, alteration, enlargement or moving of any structure upon any lot, lots or lands within the fire limits of the city for the purpose of selling, at wholesale or at retail, any gasoline, oil, grease distillate or petroleum products.
(C) No building permit approving or authorizing the building, alteration, enlargement or moving of any structure upon any lot, lots or lands within the fire limits of the city shall be granted or issued until the City Council shall have determined that the structure will be in full compliance with the provisions of all ordinances of this code, including the provisions of all standards, rules and regulations incorporated therein, and that the structure will be otherwise reasonably fire proof.
(D) The City Council, when granting or issuing a building permit approving or authorizing the building, alteration, enlargement or moving of any structure upon any lot, lots or lands within the fire limits of the city, may include in the permit, as a precondition to the validity thereof, any specifications or requirements regarding the construction or final condition of the structure after the completion of the building, alteration, enlargement or moving, to the extent that the specifications or requirements shall be useful in ensuring that the structure will be in full compliance with the provisions of all ordinances of this code, including the provisions of all standards, rules and regulations incorporated therein, and that the structure will be otherwise reasonably fire proof.
(E) It shall be unlawful for any person granted or issued a building permit, approving or authorizing the building, alteration, enlargement or moving of any structure upon any lot, lots or lands within the fire limits of the city, which building permit includes therein, as a precondition to the validity thereof, any specifications or requirements regarding the construction or final condition of the structure after the completion of the building, alteration, enlargement or moving, to fail, neglect or refuse to comply with the specifications or requirements. It shall be unlawful for any person preparing an application for a building permit approving or authorizing the building, alteration, enlargement or moving of any structure upon any lot, lots or lands within the fire limits of the city, to willfully misrepresent or misstate thereon any material fact, plan or intention. It shall be unlawful for any person granted or issued a building permit, approving or authorizing the building, alteration, enlargement or moving of any structure upon any lot, lots or lands within the fire limits of the city, to cause or allow the structure to deviate in any material way from its manner of construction or final condition as represented in the application submitted by the person seeking the granting or issuance of the permit.
