§ 50.01  ESTABLISHMENT.
   (A)   (1)   The City Council shall have the power to purchase, construct, maintain and improve garbage disposal plants, systems or solid waste disposal areas, and to purchase equipment for the operation thereof, for the use of the city and the inhabitants thereof, and to lease or take land in fee, within or without the corporate limits of the city, by donation, gift, devise, purchase of appropriation for rights-of-way and for construction and operation of a disposal plant, system or solid waste disposal area.
      (2)   The City Council shall, from time to time, by resolution or order, designate the site of the municipal dumping grounds, either within or without the corporate limits of the city, or outside of the city’s zoning jurisdiction, the City Council shall first obtain approval of the proposed site and a license to operate a solid waste disposal area, as required by the laws of the state.
      (3)   The City Council, for the purpose of defraying the cost of purchasing, constructing, maintaining and improving garbage disposal plants, systems or solid waste disposal areas, together with the cost of purchasing equipment for the operation thereof, may levy a tax, not exceeding the maximum limit prescribed by state law upon the assessed value of all the taxable property in the city, except intangible property, in any one year, or may, when the tax is insufficient for the purpose, issue bonds of the city, for the purpose of defraying the costs, as provided by the laws of the state, including, but not limited to, Neb. RS 19-2102 and 19-2103, as amended or superseded.
   (B)   In any event, the City Council shall levy annually a sufficient tax to maintain and operate the system, plant or solid waste disposal area and to provide for the payment of the interest on and the principal of any bonds that may have been issued as hereinabove provided.
   (C)   The City Council shall have the power to provide by ordinance for the management and operation of municipal garbage disposal plants, systems and solid waste disposal areas, the rates to be charged for the service, including collection and disposal, the manner of payment and collection thereof and to prescribe penalties for the violation of the ordinances, and to do whatever is necessary to protect the general health in the matter of removal and disposal of garbage.
