§ 98.03 USE.
   (A)   All temporary, individual sales of produce within the city limits of Auburn shall be limited to the designated Auburn Roadside Market herein created. This shall not apply to the sale of produce sold within a permanent retail establishment or to yard sales as permitted by city ordinances.
   (B)   Only the sale of agricultural or home-based products shall be allowed at the Auburn Roadside Market, including but not limited to fruits, vegetables, flowers, ornamental plants, eggs, baked goods, canned or homemade goods, and other products commonly grown or produced in an agricultural or home setting. The sale of live animals is prohibited.
   (C)   The Auburn Roadside Market shall be open daily for vendors on a first come, first serve basis. No sales shall be conducted at the Auburn Roadside Market after dark.
   (D)   No vehicles or items are to be left at the Auburn Roadside Market overnight, and the area should be left clean with no trash, rubbish, or debris on the ground daily.
   (E)   The sale of any unwholesome, damaged, or spoiled products shall be prohibited.
   (F)   Any vendor at the Auburn Roadside Market shall first obtain a permit from the City Clerk's office at no charge. Permits shall be issued for January 1 through June 30 and July 1 through December 31. At the time of obtaining the permit, vendors shall be required to execute a waiver of liability on behalf of the city.
