§ 32.24 DEPUTY MARSHALS; POLICE RESERVES.
   (A)   Authority. This section is made by the Town Council pursuant to the authority granted it by I.C. 36-5-7-6 and 36-8-3-20.
   (B)   Deputy marshals.
      (1)   The Marshal is authorized, subject to the consent of the Town Council and subject to the budgetary ordinances of the town, to appoint deputy marshals who shall have the powers and liabilities of the Marshal in executing the orders of the Town Council and enforcing the laws.
      (2)   The Town Council shall fix the number of deputy marshals and shall fix the amount of bond, compensation, and term of service of deputy marshals. However, a deputy marshal who has been employed by the town for more than six months after completing the minimum basic training requirements adopted by the Law Enforcement Training Board under I.C. 5-2-1-9 may be dismissed only if the procedures prescribed by I.C. 36-5-7-3 are followed.
   (C)   Police reserves. The Town Council may appoint any number of persons as police reserves who shall serve at the pleasure of the Town Council.
      (1)   Police reserves shall not be members of the regular Police Department of the town.
      (2)   Police reserves shall have only those powers as provided by the rules and regulations adopted by the Town Council and as set forth or limited by statutes, rules, and regulations of the state.
      (3)   Members of the town Police Reserve, to the extent that sums, if any, for benefits are appropriated by the Town Council, may receive a uniform allowance.
      (4)   Members of the town Police Reserve are not eligible to participate in any pension programs provided for regular members of the Department.
      (5)   The Town Council is not required to appropriate any sums of money for benefits, compensation, insurance, and other allowances for members of the Police Reserve, and in those instances members of the Police Reserve shall provide their own uniforms and shall serve without receiving any type or form of compensation or benefits from the town nor shall they make or file a claim against the town for benefits, compensation, or allowances.
      (6)   A police reserve may not be appointed until he or she has completed the training and probationary period specified by rules of the Police Department and the laws of the state.
